Milk & Spoon — Terms of Use (EULA)

By downloading or using the "Milk & Spoon · Baby Feeding Tracker" application (the "App"), you accept these Terms of Use. If you do not accept them, please do not use the App.

In these Terms, the expressions "developer" / "Provider" refer to the natural person Turkuaz ŞENGÜL, who operates the "Milk & Spoon" brand. In the sale of the Premium subscription, the seller capacity belongs to Apple (see articles 4.A and 5).

Summary: Your data stays in Türkiye. Your feeding, milk-pumping, milk-stock and meal/plate records are lifestyle data; your allergy notes are treated as health data out of caution. No advertising, analytics or third-party tracking is used; only pseudonymous technical error logs are sent abroad.

1. Definition and Purpose

The App is a personal tracking tool that helps you record babies' transition to solid food and their possible allergic reactions. The App is not a medical device; it does not provide diagnosis, identification, treatment or medical advice. The App works local-first: records are first stored on your device, and after you create an account they are backed up encrypted to our server within the borders of Türkiye.

2. Disclaimer

  • The App's content is for informational and personal record-keeping purposes only and does not replace medical advice.
  • We recommend that you make decisions regarding your baby's feeding and health by consulting your pediatrician.
  • The food information and observation tools in the App are general in nature; each baby's situation is different.
  • In a health emergency, turn not to the App but immediately to healthcare institutions; in case of severe allergic reaction signs, call your local emergency number (112 in Türkiye).

3. Limits of Use

  • You may use the App only in the capacity of the guardian/legal representative of the baby whose records you keep.
  • You may not use the App for unlawful purposes, in a way that infringes the rights of others, or for the purpose of reverse engineering.
  • You are responsible for the accuracy of the data you enter.
  • You are responsible for the content you enter into free-text fields such as the plate name, note and description; we recommend that you do not enter third parties' personal/sensitive data or unlawful content into these fields.

4. Storage of Data

  • The data you enter is first stored locally on your device. When you create an account, it is backed up to our servers in Türkiye over an encrypted connection (HTTPS) and kept accessible only to you and the family members you invite.
  • The cloud backup stays only within the borders of Türkiye. The only data transferred abroad is the pseudonymous technical error logs sent to Sentry (UUID + stack trace; does not send baby name/email/IP).
  • With the "Delete Account" feature, your cloud copy is permanently deleted within 30 days; records on the device can also be removed by deleting the App.
  • If you lose, reset, or delete the App from your device, local data may be lost; if cloud backup is active, it is restored when you reconnect with the same account. The developer cannot be held responsible for user-generated data loss.

4.A. Premium Subscription

  • A Milk & Spoon Premium subscription is required for family sharing (inviting a partner, grandmother, caregiver) and extended statistics. Basic logging features (food diary, the 3-day rule, allergy notes, milk pumping, milk stock) are free.
  • The subscription is purchased through the Apple App Store; payment, automatic renewal and cancellation are subject to Apple's standard flow. You can cancel your subscription at any time from iPhone Settings → Apple ID → Subscriptions.
  • One Premium subscription is sufficient for the entire family; the family members you invite make no additional payment (inherited premium).
  • We announce price changes in advance; your current-period price is guaranteed.
  • Pursuant to article 15/(ğ) of Law No. 6502 on the Protection of the Consumer, there is no right of withdrawal for digital content supplied electronically once use has begun; you are deemed to have approved this at the time of purchase.
  • For early users, the Founder lifetime entitlement is a reserve mechanism granted manually by the developer that covers all Premium features for as long as it remains active.

5. Apple Terms

The App is offered through the App Store. Apple is not a party to these Terms; responsibility for the App belongs to the developer. The provisions of the Apple Media Services and the App Store Licensed Application End User License Agreement (Apple Standard EULA) are reserved and apply together with these Terms.

6. Intellectual Property

The design and content of the App and the "Milk & Spoon" brand belong to the developer. You are granted only a personal, non-transferable, non-exclusive right of use.

7. Limitation of Liability

Without prejudice to the mandatory rules of applicable law, the developer cannot be held liable for indirect damages, data loss or loss of profit that may arise from use of the App. Pursuant to article 115 of the Turkish Code of Obligations, provisions that exclude/limit in advance the developer's liability arising from gross fault or intent are invalid; the limitations of liability in these Terms apply within this mandatory limit.

8. Changes and Termination

The developer may update these Terms; significant changes are announced within the App or on the website. In case of use contrary to the Terms, access may be restricted. You can always end your use by deleting the App.

9. Governing Law and Disputes

These Terms are governed by Turkish law. In disputes, the Istanbul Courts and Enforcement Offices have jurisdiction. Your rights regarding the application authorities mandatorily designated by consumer legislation arising from your consumer status are reserved.
